Terms of Services

These Terms and Conditions govern your use of AVÉYA's services. By booking a treatment appointment, you will sign and confirm that you have read, understood, and agreed to abide by these terms.

Terms and Conditions

1. Booking and Payment:

Full payment is required at the time of booking to secure a treatment appointment.

 

Appointments will not be confirmed without payment in advance.

 

Prices are subject to change at any time without prior notice.

 

Promotional pricing cannot be combined with other offers or discounts.

 

Late payments will incur a penalty of 15% of the total amount.

 

2. Treatment Cancellation Policy:

Once an appointment is booked and payment is made, cancellations are strictly not permitted.

 

In case of cancellation by the client, no refunds will be issued. However, credits may be provided for future treatments at the provider’s discretion if outside the notification window.

 

3. Refund Policy:

All treatments have a strict no-refund policy once booked and paid for.

 

There are no refunds on medications purchased. Clients are responsible for conducting due diligence regarding the legality and importation of medications into their own country. The provider assumes no responsibility for issues related to customs, importation, or usage of medications outside Thailand.

 

Any exceptions to this policy are solely at the discretion of the provider’s management.

 

4. Rescheduling Policy:

Rescheduling requests must be submitted at least 72 hours (3 days) before the scheduled appointment for stem cell treatments and at least 72 hours (3 days) for regular treatments.

 

A rescheduling fee of 7,000 THB will apply for stem cell treatments.

 

In cases of extreme weather or unforeseen circumstances preventing treatment, priority will be given to reschedule the appointment at the earliest availability.

 

5. Late Arrival Policy:

Clients are expected to arrive on time for their appointments. Late arrivals may result in reduced treatment time or rescheduling, subject to availability, and may incur additional fees.

 

6. Treatment Suitability:

All clients must undergo a pre-treatment assessment by the provider’s medical professionals to determine treatment suitability. The provider reserves the right to cancel or modify treatment plans based on these assessments.

 

The provider reserves the right to refuse or discontinue treatment if deemed unsuitable for the client based on medical assessments and professional judgment.

 

7. Liability:

The provider shall not be held liable for any loss, damage, injury, or death resulting from treatments or services rendered, except as required by law.

 

Clients acknowledge that treatments carry inherent risks, and the provider is not responsible for any adverse outcomes, including death or injury.

 

8. Patient Responsibility:

Clients are responsible for providing accurate and complete medical history and information relevant to their treatments.

 

Clients must adhere to all pre- and post-treatment care instructions provided by the provider.

 

9. Confidentiality and Privacy:

The provider is committed to protecting client privacy. Any personal or medical information provided will be handled in compliance with applicable privacy laws and will not be shared without the client’s consent except as required by law.

 

10. Medical Emergency Disclaimer:

In case of a medical emergency during treatment, the provider will take all reasonable steps to assist the client. However, the provider shall not be held liable for unforeseen complications arising from pre-existing conditions not disclosed by the client.

 

11. Force Majeure:

The provider is not responsible for delays, cancellations, or interruptions caused by events beyond its control, including but not limited to natural disasters, pandemics, strikes, or governmental actions.

 

12. Non-Transferability:

Treatment bookings, credits, and packages are non-transferable and can only be used by the individual whose name is on the booking.

 

13. No-Show Policy:

Clients who fail to attend their scheduled appointment without prior notice will forfeit their payment, and no rescheduling or refund will be provided.

 

14. Payment Methods and Refund Timeline:

Payment must be made via approved methods (e.g., bank transfer, credit card, or other agreed-upon means).

 

If a refund exception is granted, it may take up to 14 business days to process, depending on the payment method used.

 

15. Client Behavior:

The provider reserves the right to refuse service or treatment if the client exhibits abusive, threatening, or inappropriate behavior toward staff or other clients.

 

16. Equipment and Property Damage:

Clients will be held responsible for any damages caused to the provider’s property or equipment resulting from negligence or misuse.

 

17. Changes to Terms and Conditions:

The provider reserves the right to amend these terms and conditions without prior notice.

 

The terms and conditions in effect at the time of booking will apply to the client.

 

18. Post-Treatment Follow-Up:

The provider may recommend follow-up appointments or tests after treatment. It is the client’s responsibility to adhere to these recommendations for optimal results.

 

19. Photos and Testimonials:

Clients may be asked to provide consent for the use of their photos, videos, or testimonials for marketing purposes. Such consent will be explicitly obtained, and clients have the right to decline without affecting their treatment.

 

20. Treatment Outcome Disclaimer:

The provider makes no guarantees about the effectiveness of treatments, as results may vary based on individual circumstances. Clients acknowledge that outcomes cannot be predicted with certainty.

 

21. Third-Party Services:

If any part of the treatment involves services provided by third-party providers, the provider is not responsible for any issues arising from those services, including delays or adverse outcomes.

 

22. Package Expiry Policy:

Packages or pre-purchased treatments must be used within 12 months from the date of purchase unless otherwise agreed upon. Expired treatments will not be refunded or extended.

 

23. Informed Consent:

Clients confirm that they have been informed of the nature, purpose, and risks associated with the proposed treatments and have had all their questions answered to their satisfaction.

 

24. Assumption of Risk:

Clients acknowledge and accept any risks inherent in undergoing medical treatments, including but not limited to pain, discomfort, side effects, or unsatisfactory results.

 

25. Voluntary Participation:

Clients confirm that they are voluntarily undergoing treatments and have not been coerced or misled into making this decision.

 

26. Pre-Treatment Instructions:

Clients are responsible for following all pre-treatment instructions provided by the provider. Failure to comply may affect the outcome and safety of the treatment.

 

27. Post-Treatment Care:

Clients agree to follow all post-treatment care instructions provided by the provider. Failure to comply may result in complications, for which the provider assumes no responsibility.

 

28. Medical History Accuracy:

Clients confirm that they have disclosed all relevant medical history, conditions, and current medications. The provider is not responsible for complications arising from undisclosed or inaccurate medical information.

 

29. No Warranty of Outcome:

Clients understand that the provider does not guarantee specific results or outcomes from treatments.

 

30. Emergency Procedures:

Clients consent to emergency medical procedures, if necessary, during treatment. Any associated costs will be the responsibility of the client.

 

31. Release of Liability for Travel:

If traveling for treatment, clients accept responsibility for any risks associated with travel and accommodation, including delays, accidents, or illness.

 

32. Arbitration Clause:

Any disputes arising from treatments will be resolved through arbitration before pursuing litigation.

 

33. Non-Disparagement Agreement:

Clients agree not to make public statements, reviews, or claims that are defamatory or misleading about the provider or treatments.

 

34. Governing Law:

These terms and conditions are governed by and construed in accordance with the laws of Surat Thani, Thailand.

 

Any disputes arising from these terms and conditions shall be subject to the exclusive jurisdiction of the courts in Koh Samui, Surat Thani, Thailand.

 

35. Acknowledgment:

By booking a treatment appointment, clients confirm that they have read, understood, and agreed to abide by these terms and conditions
